1. Introduction and Acceptance
Welcome to MyHeartDiary (the "App"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and Digital Health Tracker Limited ("we", "us", "our"). By registering for an account, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.
2. Strictly Not Medical Advice (Medical Disclaimer)
MyHeartDiary is a digital diary designed to help you track personal heart health metrics (such as fluid intake, weight, and blood pressure).
- Not a Medical Device: This App is not a medical device, nor is it intended to diagnose, treat, cure, or prevent any disease, including heart failure.
- No Medical Advice: The data and insights provided by the App are for informational purposes only. They do not constitute professional medical advice.
- Always Consult a Doctor: Never disregard professional medical advice or delay seeking it because of something you have read on this App.
- Emergencies: Do not use this App in a medical emergency. Call 999 immediately if you experience severe symptoms.
- NHS Independence: This App is a privately developed tool and is not affiliated with, endorsed by, or connected to the National Health Service (NHS) or any NHS Trust.
3. User Accounts and Security
- To use the App, you must be at least 18 years old.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, current, and complete information when registering. We are not responsible for any issues arising from inaccurate health data entered by you.
4. Premium Subscriptions and Payments
The App offers a free version and a "Premium" subscription with additional features.
- Billing: If you choose to upgrade, you agree to pay the fees displayed at the time of purchase. Subscriptions bill automatically on a monthly/annual basis.
- Cancellation: You may cancel your subscription at any time through your account settings or the applicable app store (Apple App Store / Google Play). Cancellation will take effect at the end of your current billing cycle.
- 14-Day Cooling-Off Period (UK Consumers): Under UK law, you have the right to cancel your Premium subscription within 14 days of purchase for a full refund. However, if you actively use the Premium digital features within this 14-day period, you explicitly waive your right to a refund.
5. Acceptable Use
You agree not to:
- Use the App for any illegal or unauthorized purpose.
- Attempt to hack, reverse-engineer, or disrupt the App's servers or networks.
- Enter malicious code, viruses, or falsified data into the system.
6. Intellectual Property
All content, design, text, graphics, and underlying code of the App are owned by Digital Health Tracker Limited and are protected by UK and international copyright laws. You are granted a limited, non-exclusive license to use the App for personal, non-commercial purposes.
7. Limitation of Liability
To the maximum extent permitted by UK law:
- We provide the App on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind.
- We shall not be liable for any direct, indirect, incidental, or consequential damages, including personal injury, resulting from your use or inability to use the App, or from your reliance on any data tracked within the App.
- We are not responsible for the security of data once you choose to share it outside the App (e.g., emailing a report to your doctor).
8. Termination
We reserve the right to suspend or terminate your account at any time, without notice, if you violate these Terms or if we decide to discontinue the App.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
